3. Payments and Fees
3.1 Website Development Services
– A 50% advance payment is mandatory before the commencement of any website development project.
– The remaining balance must be paid upon project completion and before the final delivery.
3.2 Digital Marketing Services
– For digital marketing services such as SEO, Social Media Management, Meta Ads, Google Ads, Local SEO, Snapchat, TikTok, and YouTube Channel Management, payment must be made in full on a monthly upfront basis.
– Services will commence only after the receipt of the monthly payment.
3.3 Video Editing and Content Generation
– Payment for video editing and content generation services will be agreed upon in advance based on the project scope.
– Full payment is required upfront for smaller projects, while larger projects may require a milestone-based payment structure.
3.4 Business Marketing Consultation
– Fees for business marketing consultation are charged on an hourly or project basis, as agreed upon prior to the start of the consultation.
– Payment must be made in advance unless otherwise stated in the agreement.
3.5 No Refund Policy
– All payments made to WebFix Media Advertising are non-refundable, under any circumstances.
– By making a payment, you acknowledge and accept this no-refund policy.
4. Client Responsibilities
– Clients must provide all necessary materials, content, and information required for the execution of the project or services in a timely manner.
– Clients are responsible for ensuring the accuracy and legality of the materials they provide.
– Clients must communicate clearly regarding project expectations, revisions, and deadlines.
5. Intellectual Property
– WebFix Media Advertising retains ownership of all designs, codes, and materials created during the website development process until full payment is received.
– Upon full payment, ownership rights to the delivered work will transfer to the client.
– For digital marketing services, any proprietary strategies, tools, or methodologies remain the intellectual property of WebFix Media Advertising.
– Content created as part of video editing and content generation services may be used for promotional purposes by WebFix Media Advertising unless otherwise agreed upon in writing.
6. Limitation of Liability
– WebFix Media Advertising shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our services or Website.
– We do not guarantee specific results for digital marketing campaigns, as outcomes depend on various external factors beyond our control.
– For video editing and content generation, the client is responsible for final approvals before publication or use.
7. Termination of Services
– Either party may terminate the services with a written notice of 15 days.
– Upon termination, any outstanding payments for work completed must be settled immediately.
– WebFix Media Advertising reserves the right to terminate services without notice in cases of breach of these Terms.
8. Confidentiality
– Both parties agree to maintain confidentiality of any proprietary or sensitive information exchanged during the course of the project or service.
– WebFix Media Advertising will not disclose any client-provided information unless required by law or agreed upon in writing.
9. Governing Law
– These Terms and any disputes arising from them will be governed by the laws of India, specifically the jurisdiction of Tanda Urmar, Distt: Hoshiarpur, Punjab.
– All legal issues, disputes, or matters related to these Terms will be resolved exclusively in the local courts of Tanda Urmar, Distt: Hoshiarpur, Punjab.
10. Amendments to Terms
WebFix Media Advertising reserves the right to amend these Terms at any time. Any changes will be posted on the Website, and continued use of our services constitutes acceptance of the updated Terms.
